PARK CITY MUNICIPAL CORPORATION BOARD OF ADJUSTMENT CITY COUNCIL CHAMBERS 445 Marsac Avenue February 11, 2020 LEGAL NOTICE REGULAR SESSION -- 5:00 PM -- Items listed below may include discussion, public hearing, and action Appeal of the 1330 Empire Avenue, 1302 Norfolk Avenue, 1361 Woodside Avenue, and 1323 Woodside Avenue (Woodside Park Phase II Master Planned Development) -Ratification of Findings of Fact for the Appeal of a Planning Commission Remand. On July 16, 2019, the Board of Adjustment heard an Appeal of the May 22, 2019 Planning Commission approval of the Master Planned Development application and remanded the review of Setbacks for the Master Planned Development application to the Planning Commission pursuant to LMC 15-6-5(C). On September 11, 2019, the Planning Commission reviewed the updated submittal for compliance with 15-6-5(C) Master Planned Development Requirements Setbacks and on October 9, 2019 adopted Findings of Fact, Conclusions of Law, and Conditions of Approval reaffirming their May 22, 2019 approval of setbacks, with the exception of eliminating the front yard setback reduction along Empire Avenue. On October 18, 2019, the City received an Appeal of the October 9, 2019 Planning Commission final action on setbacks. The appeal and public hearing are regarding the setbacks approved by the Planning Commission pursuant to 15-6-5(C) Master Planned Development Requirements Setbacks. On December 10, 2019, the Appeal was continued by the Board of Adjustment to the January 21, 2020 meeting date. On January 21, 2020, the Board of Adjustment determined that the findings of the Planning Commission in reference to LMC 15-6-5(C) MPD Requirements - Setbacks were inadequate and directed staff to prepare findings to grant the Appeal.
